Ukraine's Yanukovich shrugs off criticism of election

KIEV (Reuters) - Ukrainian President Viktor Yanukovich shrugged off international criticism on Tuesday of an election which showed his party on a winning course, while opposition nationalists alleged vote-rigging and threatened possible street protests.

With the count from Sunday's vote nearing its end, Yanukovich's Party of the Regions and its communist allies were set to retain a comfortable majority in the 450-seat parliament to cement his grip before he seeks a second term in 2015.

The Organisation for Security and Cooperation in Europe, which sent 600 observers, called the election a "step backward" for Ukraine's democracy. It said state resources were misused to support the ruling party and media were biased, and noted that Yanukovich's main rival, ex-prime minister Yulia Tymoshenko, is in jail. It did not however criticize the voting itself.

"The observers gave a positive assessment to the process of voting," Yanukovich said in a statement that ignored the OSCE's critical comments about the election campaign.

U.S. Secretary of State Hillary Clinton backed the OSCE criticism and called on Yanukovich to free Tymoshenko.

"We share the view of OSCE monitors that Sunday election constituted a step backward for Ukrainian democracy," Clinton said, adding that "politically motivated convictions" of opposition leaders like Tymoshenko had kept them from standing.

Tymoshenko has announced a hunger strike in protest against what she called electoral fraud. Her party has yet to make a statement on results that show it placing second and losing about a third of its parliamentary representation.

The election will bring two other opposition parties into parliament for the first time, making the fractious body even rowdier - a liberal bloc led by world heavyweight boxing champion Vitaly Klitschko, and a far right group. Each looked set to secure about 35-40 seats, enough to make them viable fixtures on Ukraine's political scene.

The communists invoked Ukraine's pre-World War Two past to condemn the arrival of the far-right Svoboda (Freedom) party, whose showing was surprisingly strong.

Since coming to power in February 2010, Yanukovich, whose power base lies in the Russian-speaking areas of the east and south, has pressed ahead with policies which opponents say favor the big business industrialists who back him.

The former Soviet republic of 46 million has become increasingly isolated because of the jailing of Tymoshenko, with the European Union refusing to settle a major free trade pact.

COST OF PROMISES

Corruption is a big concern in Ukraine and many ordinary Ukrainians suffer economic hardship. Voters were frustrated with the performance of the established political parties.

Even in areas that traditionally support the Party of the Regions, some voters said they were disillusioned by government policies on tax and pensions. But public sector wage increases, welfare handouts and promises to boost the status of the Russian language appeared to have won over many waverers.

Those election-driven economic policies have had a cost. The state budget deficit reached almost $1 billion in September and the hryvnia slipped to an eight-week low on Tuesday as people expect depreciation after the vote.

Half of seats are allocated to candidates who win the most votes in individual constituencies, and half to parties by proportional representation. With 87 percent of votes counted, figures from the Central Electoral Commission showed the Regions had won 117 constituency seats and 75 from party lists.

Though this was short of the outright 226-seat majority, the Regions should easily make up the shortfall by cutting deals with their traditional communist allies, who placed third in the party list tally, and independents.

Tymoshenko, 51, is serving a seven-year jail sentence for abuse of office over a gas deal she brokered with Russia in 2009 when she was prime minister. She is an old enemy of Yanukovich's going back to 2004 when she led the "Orange Revolution" protests which doomed his first bid for the presidency.

The leadership of her Batkivshchyna (Fatherland) bloc has yet to make a declaration on the election. The count showed it with an estimated 103 seats, down from 156 at the last election.

The Ukrainian nationalist Svoboda party, which is allied to other far-right groups in Europe, said votes had been stolen from its candidates and its leader threatened street action alongside Batkivshchyna and other opposition groups.

"We have evidence of large-scale theft of votes from Svoboda," leader Oleh Tyahnybok told journalists, saying that 3 percent of Svoboda's vote in the party lists and 4 seats in the single-mandate constituencies had been "stolen" from it.

"We have agreed with our partners Batkivshchyna that if there is any call for people to turn out on the streets in mass demonstrations then we will do this only together," he said.

Communist leader Petro Symonenko called Svoboda's arrival in parliament "a tragedy for Ukraine", harking to European fascism: "I refer you to the history of the 1920s and 1930s."

Survive Hurricane Sandy With SelfControl - Business Insider

As Hurricane Sandy barrels along the East Coast, recovering online shopaholics like myself have something more to worry about than just battening down the hatches.

This is the perfect storm for a relapse.?

In less than an hour of home confinement, I've already purchased a flat iron, a spa treatment, and a Groupon for a mani/pedi. Of course, none of these are things I need, and already that immediate rush I get from nailing a great deal has been smothered by the familiar crush of buyer's remorse.

And this is just day one of a four-day monster.

It's time for an intervention, and I'm taking no chances with my finances here. I've downloaded the Self Control app for macs, which is a site virtually guaranteed to keep distracting web browsing at bay.

Download the app, and you can "blacklist" certain sites, which will block access from your IP address for a certain period of time. That means until the timer runs out, you can't so much as look at a site without getting blocked. Restarting your computer won't even work, and you can block sites for up to 24 hours at a time.

The app was created by novelists who needed to find a way to get work down at their computers without getting sucked into the big wide world of the Web. Trust me. It is probably the most frustrating tool ever created, but it actually works.

Give it a try, or hope the power goes out before you go broke.

(AP) ? Tens of thousands rallied in Pakistan's largest city Sunday in the biggest show of support yet for a 14-year-old girl who was shot and seriously wounded by the Taliban for promoting girls' education and criticizing the militant group.

The Oct. 9 attack on Malala Yousufzai as she was returning home from school in Pakistan's northwest horrified people inside and outside the country. At the same time, it gave hope to some that the government would respond by intensifying its fight against the Taliban and their allies.

But protests against the shooting have been relatively small until now, usually attracting no more than a few hundred people. That response pales in comparison to the tens of thousands of people who held violent protests in Pakistan last month against a film produced in the United States that denigrated Islam's Prophet Muhammad.

Demonstrations in support of Malala ? and against rampant militant violence in the country in general ? have also been fairly small compared with those focused on issues such as U.S. drone attacks and the NATO supply route to Afghanistan that runs through Pakistan.

Right-wing Islamic parties and organizations in Pakistan that regularly pull thousands of supporters into the streets to protest against the U.S. have less of an incentive to speak out against the Taliban. The two share a desire to impose Islamic law in the country ? even if they may disagree over the Taliban's violent tactics.

Pakistan's mainstream political parties are also often more willing to harangue the U.S. than direct their people power against Islamist militants shedding blood across the country ? partly out of fear and partly because they rely on Islamist parties for electoral support.

One of the exceptions is the political party that organized Sunday's rally in the southern port city of Karachi, the Muttahida Quami Movement. The party's chief, Altaf Hussain, criticized both Islamic and other mainstream political parties for failing to organize rallies to protest the attack on Malala.

He called the Taliban gunmen who shot the girl "beasts" and said it was an attack on "the ideology of Pakistan."

"Malala Yousufzai is a beacon of knowledge. She is the daughter of the nation," Hussain told the audience by telephone from London, where he is in self-imposed exile because of legal cases pending against him in Pakistan. His party is strongest in Karachi.

Many of the demonstrators carried the young girl's picture and banners praising her bravery and expressing solidarity.

The leaders of Pakistan's main Islamic parties have criticized the shooting, but have also tried to redirect the conversation away from Taliban violence and toward civilian casualties from U.S. drone attacks.

Cyril Almeida, a columnist for Pakistan's Dawn newspaper, said this type of "obfuscation" prevents Pakistanis from seeing "there is a continuum from the religious right to violent Islamism."

"The religious right creates an enabling environment for violent Islamism to recruit and prosper. And violent Islamism makes state and society cower and in doing so enhances the space for the religious right," Almeida wrote in a column Sunday.

Malala earned the enmity of the Pakistani Taliban for publicizing their behavior when they took over the northwestern Swat Valley, where she lived, and for speaking about the importance of education for girls.

The group first started to exert its influence in Swat in 2007 and quickly extended its reach to much of the valley by the next year. They set about imposing their will on residents by forcing men to grow beards, preventing women from going to the market and blowing up many schools ? the majority for girls.

Malala wrote about these practices in a journal for the BBC under a pseudonym when she was just 11. After the Taliban were pushed out of the Swat Valley in 2009 by the Pakistani military, she became even more outspoken in advocating for girls' education. She appeared frequently in the media and was given one of the country's highest honors for civilians for her bravery.

The military carried out its offensive in Swat after a video surfaced of a militant flogging a woman who had allegedly committed adultery, which helped mobilize public support against the Taliban.

Many hope the shooting of Malala will help push the military to undertake a long-awaited offensive in the Pakistani Taliban's last main sanctuary in the country in the North Waziristan tribal area.

The Pakistani Taliban said they carried out the shooting because Malala was promoting "Western thinking." Police have arrested at least three suspects in connection with the attack, but the two gunmen who carried out the shooting remain at large.

The young girl was shot in the neck, and the bullet headed toward her spine. Two of her classmates were also wounded in the attack.

Doctors at a military hospital operated on Malala to remove the bullet from her neck, and she was put on a ventilator. Her condition improved somewhat on Saturday when she was able to move her legs and hands after her sedatives were reduced.

On Sunday, she was successfully taken off the ventilator for a short period and later reconnected to avoid fatigue, the military said. Doctors are satisfied she is making slow and steady progress and will decide whether to send her abroad for treatment. They have not said whether she suffered any brain damage or other type of permanent damage.

The United Arab Emirates plans to send a specialized aircraft to serve as an ambulance for the girl in case doctors decide to send her abroad, the Pakistani ambassador to the country, Jamil Ahmed Khan, said Sunday.

Visas are being finalized for the air ambulance crew and six doctors who will accompany the flight, Khan told Pakistan's Geo TV. Arrangements have been made to treat the girl at three hospitals in Dubai and Abu Dhabi, he said.

The UAE Embassy in Islamabad could not immediately be reached for comment.

No decision has yet been taken to send the girl abroad, but the air ambulance is part of the contingency plan, the Pakistani military said.

Afghan President Hamid Karzai has written letters to top political and religious leaders in Pakistan denouncing the attack on Yousufzai and asking them to help battle extremism in both countries, the president's office said in a statement issued late Saturday. Karzai wrote that he views the shooting as an attack on Afghanistan's girls as well.

Libya police colonel targeted in assassination attempt

BENGHAZI, Libya (Reuters) - A police car exploded on Saturday during a failed assassination attempt on a police colonel in the eastern city of Benghazi, a Libyan police official said.

The attack was the latest in a series of assassination attempts in Benghazi, the cradle of last year's uprising which ousted Muammar Gaddafi, and where U.S. ambassador Christopher Stevens was killed in a September 11 attack on the U.S. consulate.

Unknown suspects placed a home-made bomb under Colonel Mohammed Ben Haleem's car which was parked outside his house, police spokesman Majed al-Obeidi said.

"The colonel turned his engine on to warm up the car, then stepped back into the house to retrieve something. That's when the car exploded," he told Reuters.

Obeidi said the explosion in the central Benghazi neighborhood of al-Hadayeq caused no injuries or deaths.

Ben Haleem was a police colonel under Gaddafi and resumed his post in the new government after the uprising.

On August 10, gunmen shot dead Libyan army general Mohammed al-Fitori in Benghazi when he was leaving Friday prayers. The bullets were fired from a passing car.

Fitori had defected from Gaddafi's government during last year's revolt and later became head of ammunition and armament for the army.

In early September, a Libyan intelligence officer was killed and another wounded when their car exploded in Benghazi.

A bomb planted in the car, which belonged to one of the officers, was remotely detonated when the two got into the vehicle in a busy shopping district of the Mediterranean city.

How You Can Talk To Your Partner About Your Depression ...

Writing in your journal every day can be a very good way to begin getting a handle on your depression. Write out your thoughts at the beginning and end of each day. When you do this, you are enlisting the help of your subconscious mind to sort out your worries and problems while you sleep.

Getting enough exercise and a healthy, nutritious diet are essential to dealing with your depression. They shouldn?t be seen as quick fixes, though, but as part of a long-term strategy towards turning your life around. A healthy breakfast or dinner and a vigorous walk or bike ride can really brighten your mood.

Complex carbohydrates in your diet will help to relieve some of the nervous and sad feelings that you may be experiencing. If you take the time to eat things that are high in complex carbohydrates, you will naturally be fighting off those nervous feelings that leave you uncomfortable and unhappy. Use your diet to win your battle.

Volunteer, take a class or join a social club to keep yourself active and meeting new people. One of the most difficult aspects of depression is the isolation that can come with it. By finding activities and groups you enjoy, you are more likely to spend time with others, thus alleviating the isolation and sense of loneliness that can accompany depression.

Clean your house, one room a day if necessary, when you feel depressed. It is normal to have little or no motivation when depressed and this contributes to a messy house. This is a vicious cycle though, as a messy house can lead to more depression. Cleaning your house leads to an improved mood.

If you are feeling depressed, it might be time to evaluate your friendships. Some friends can be toxic, and damaging to your health. Sometimes cutting such people out of your life can be beneficial. If you surround yourself with happy individuals who are mentally healthy, you just might start to feel that way too.

When your depression is at its worst, try reading a books. Books are a way for anyone to get away from reality and for depressed people, reading their favorite book can help take their minds off of their depression. Just try to stay way from books that will make you sad.

Something as simple as exercise can seriously have a positive and lasting effect on your depression. Make sure that you?re doing whatever you can to be active whenever you can. Go purchase a treadmill or an exercise bike. Pick up landscaping as a hobby. Get in the habit of walking the dog. Become active.

Depression is a chronic mood disorder, and thus it?s hard to find a lot of medical professionals who put much credence in it. As a depression sufferer; however, you know just how real it all is. Remember to use what you?ve read here to begin traveling on your road to recovery.

When you make millions giving financial advice to other people, the last thing anyone expects is for you to go bankrupt. Robert Kiyosaki, author of the best-selling book, ?Rich Dad, Poor Dad,? has filed for bankruptcy. Kiyosaki made the move after being wiped out by a $24 million dollar lawsuit that he lost to the Learning Annex.

Kiyosaki?s Rich Global LLC filed for bankruptcy after being ordered to pay nearly $24 million to the Learning Annex and its founder and chairman, Bill Zanker.

US District Judge Shira A. Scheindlin in April ordered Rich Global to pay up $23,687,957.21 after a jury ruled Kiyosaki must give the Learning Annex a percentage of his profits after using their platform for speaking engagements, including a 2002 gig at Madison Square Garden. Rich Global filed for bankruptcy in Wyoming on Aug. 20.

Zanker told us, ?I took Kiyosaki?s brand and made it bigger. The deal was I would get a percentage, and he reneged. We had a signed letter of intent. The Learning Annex is the greatest promoter. We put his ?Rich Dad? brand on a stage. We truly prepared him for great fame and riches.

But when it was time for him to pay up, he said ?no.? ? This has taken years in court. I won even more money than I asked for from the jury, then he declared corporate bankruptcy. Oprah believed in him, and Will Smith believed in him, but he didn?t keep his promise to us.?

?Robert and [wife] Kim are not paying out of personal assets. We have a few million dollars in this company, but not 16 or 20. I can?t do anything about a $20 million judgment . . . We got hit for what we think is a completely outlandish figure.?

Sounds like Kiyosaki won. He didn?t declare personal bankruptcy, just some defunct company with no money. Smart Dad after all.

Peru LNG Sends Cargo to Spain

Peru LNG shipped a cargo of liquefied natural gas to Spain on October 11, according to PeruPetro S.A.

The cargo is being hauled by the 173,600 cbm Castillo de Santisteban.

The Peru LNG Project includes two parts: an LNG Plant with a Marine Terminal from which LNG is sent overseas, and a pipeline connected to the existing TgP pipeline to transport natural gas from the connection point in the mountains of Ayacucho to the LNG Plant located on the coast.

Four energy companies form the PERU LNG consortium: Hunt Oil Company of the United States, with a 50% participating interest; SK Energy of South Korea, with a 20% participating interest; Repsol of Spain, also with a 20% participating interest; and Marubeni Corporation of Japan, with a 10% participating interest.

Depths hold clues to dearth of xenon in air

As detective stories go, the Mystery of the Missing Xenon may not have the catchiest title. But scientists in Germany say they might have cracked this long-standing enigma.

The reason there?s less xenon in Earth?s atmosphere than expected, the researchers say, is because there was never much xenon dissolved in the planet?s depths to begin with. Had there been, it would have made its way over billions of years toward the surface, there to spew into the atmosphere.

?This model is enough to explain the whole xenon deficiency,? says Svyatoslav Shcheka, a geochemist at the University of Bayreuth in Germany. He and Hans Keppler, also of Bayreuth, report the finding online October 10 in Nature.

Compared with meteorites that formed out of primordial solar system stuff, Earth and Mars have far less xenon in their atmospheres. Scientists have proposed many possible explanations, such as minerals that locked up xenon in the upper parts of Earth?s middle layer, the mantle.

Shcheka and Keppler had been studying minerals from far deeper, in the lower part of the mantle where intense pressure creates minerals like perovskite, rich in magnesium, silicon and oxygen. In high-pressure experiments in the lab, perovskite had been behaving unexpectedly, and the team discovered this was because the mineral?s crystal structure doesn?t always contain an oxygen atom in the space where an oxygen atom could be. Rather, something else must fill that space ? possibly a noble gas, a class of gases that includes argon, krypton and xenon.

The scientists decided to see if they could dissolve noble gases in perovskite under pressure to find the missing ingredient. They found that argon dissolved easily, to the point that it made up just over 1 percent of the mineral. Krypton dissolved less readily, and xenon dissolved hardly at all ? making up only about 0.03 percent of the perovskite. That?s probably because xenon atoms are bigger than argon and krypton atoms, and too big to slot easily into the spaces in the perovskite structure left by missing oxygen, Shcheka says.

Billions of years ago, the infant Earth was completely molten, with gases trapped within that melt. As it cooled, the new theory goes, minerals began to crystallize out and trap those gases. Perovskite that formed trapped mostly argon and some krypton, but little xenon, the scientists propose.

Meanwhile, the primordial atmosphere got mostly stripped away, perhaps blasted away by radiation or by incoming meteorites. Once the planet cooled enough it began to churn internally. Like a pot bubbling on the stove, this churning brought materials from deep within the planet to the surface, where they released their contents into the atmosphere. This journey would have involved perovskite rich in argon and poor in xenon.

?Most people have said that, ?OK, we don?t have this xenon in the atmosphere, so it should be hidden somewhere,? ? Shcheka says. ?What we say is that we will never find xenon, that it was lost already at the beginning of Earth?s evolution.?

Other scientists aren?t so sure. Chryst?le Sanloup, a geochemist at the University of Edinburgh, has studied other, shallower places in the Earth where xenon might be locked up. She says the new paper can?t explain several aspects of xenon geochemistry, including how Mars could also be lacking xenon in its atmosphere when it has very little perovskite in its depths.

Shcheka, for his part, says the atmosphere on Mars is thin enough that not much perovskite is needed to throw off its xenon composition.

STATEN ISLAND, N.Y. - ST. GEORGE - McKee High School sophomore Maliyah Greene is a member of Girls Who Code.

It may sound like the name of a girl band, but it's far from it. Girls Who Code is actually a group of high school-age girls with an interest in learning about computers and technology.

For eight weeks over the summer, Maliyah, 15, and 19 other young women, went Monday to Friday, from 9 a.m. to 5 p.m. to the AppNexus Building in Manhattan, where they learned about computer programming and engineering. The program was offered by Girls Who Code, an organization supported by Google to encourage young women to pursue careers in computer programming and technology.

The competition to become one of the Girls Who Code was stiff. Five hundred young ladies applied; only 20 were selected, and of the 20, Maliyah was the only student chosen from Staten Island.

According to Google, the purpose of Girls who Code is "to make inroads into having more young women of all socio-economic strata and ethnicities explore career paths in the tech industry."

Maliyah got to interact with top executives and designers in the tech industry. The founding director of Girls Who Code, Reshma Saujani, organized a competition for the girls to design an application (APP). Maliyah was part of the team that created an app to assist students who are English Language Learners.

The summer experience opened doors for the self-described "shy" teen from Mariners Harbor.

Maliyah will have the honor of traveling to Berkeley, Calif., next month, where she will present her APP before executives during the Intel Global Challenge conference.

She is also planning to attend the Girls Who Code Gala next week at the New York Stock Exchange, where she expects to meet and mingle with entrepreneurs, engineers and executives who will speak about increasing the number of women in technology and engineering.

"Girls Who Code has introduced me to many opportunities. We were taught by representatives from Intel, Twitter, Google, Facebook, eBay, Amazon and General Electric," she explained.

The teen said her classes at McKee have left her well-prepared for the experience.

"I've always loved to draw, but I became interested in computer science and technology around the eighth-grade, when I started looking at what high school I wanted to attend," she explained.

After attending an open house at McKee, she knew the school would be a good fit. She said she found out about the Girls Who Code program through McKee Principal Sharon Henry.

"Girls Who Code's purpose is to inspire and educate us girls 13- to 17- years-old to pursue opportunities in science, technology, engineering and math.

"I believe it is very important for girls to get involved in technology because it is a very male dominated field. Only a small percentage of women are awarded computer-science degrees," Maliyah said.

"I am a very shy person, but I do see myself as a role model for girls who want to break into this field. I always talk to my friends about the advantages of being involved in computer science.

"I would encourage girls to get involved with computers and technology, and to get involved in as many internships and programs as they can to teach them how to code," she added.

Maliyah credited her parents ? mom, Melissa Greene, who works at Primelending Mortgage in New Jersey, and dad, Michael Greene, who is a U.S. Postal Service employee ? for their support.

She said she wants to be a role model for her younger sister, Mya Greene, 8, who attends the Staten Island School for Civic Leadership, Graniteville.

In college, she said she hopes to marry her interest in drawing with computer technology, possibly by studying animation, web design, graphic arts or engineering.

"I have another year to decide."

When she's not involved with Girls Who Code, Maliyah said she enjoys listening to music on her iPod, going to restaurants and spending time with her family.

Singapore?s building regulator has announced a new scheme that rates energy-guzzling data centres on their environmental performance.

The Building and Construction Authority (BCA) said in a statement on Wednesday that the new Green Mark for Data Centres, which took two years to develop in partnership with the Infocomm Development Authority (IDA), is aimed at encouraging businesses to make their data centres more energy efficient.

The high-tech city state and Asia?s financial hub is home to many banks and big businesses that host energy-consuming data centres that power the economy.

The BCA said that Singapore?s commercial data centre space is projected to increase by 50 per cent from 2010 to 2015, and therefore ?it is important to look at how? green and sustainable data centres are, given their heavy use of energy. ?

Unveiling the scheme at the opening of the International Green Building Conference held at Marina Bay Sands on Wednesday, Minister in the Prime Minister?s Office, Ms Grace Fu, noted that energy-related costs are estimated to account for a hefty half of all operating expenditure in a typical data centre in Singapore.

?As data centres become more energy-intensive, this proportion is expected to grow over the years. These present opportunities to help data centres here embrace more green and energy efficient practices, which could then be a source of the industry?s competitive advantage,? said Ms Fu, who is also Second Minister for Environment and Water Resources and Foreign Affairs.

BCA?s move comes in the wake of increased scrutiny on how the highly-wired modern society is affecting the environment. The New York Times recently published a series on how data centres were wasting vast amounts of energy ? debunking the notion that going digital meant going green.

The agency estimates that a typical large data centre in Singapore consumes energy equivalent to 10,000 households. Greening such data centres can help businesses achieve energy savings of up to 30 per cent, noted BCA.

Data centres that either occupy a purpose-built data centre building or are part of a larger building are eligible for the scheme, which assesses data centres based on five key criteria ? energy efficiency, water efficiency, sustainable construction and management, and indoor environment quality as well as other green features.

Three data centres in Singapore ? the Credit Suisse Regional Data Centre, Equinix SG2 Data Centre and the Singapore Tourism Board Data Centre ? were named as the first to gain the new Green Mark ratings.

Banking giant Credit Suisse?s 10,000 sq ft centre was given the highest Platinum rating for its features such as efficient air-conditioning system and IT equipment, and using technology to reduce overall power demand.

The features helped the firm achieve energy savings of 3.85 million kilowatt hours annually, or cost savings of $1 million. A similar-sized data centre in Singapore consumes an average of 18.1 million kWh annually.

BCA?s chief executive John Keung said that while the original Green Mark scheme focused on building owners, ?we are now shifting our attention to occupants.?

?Placing greater emphasis on users will help instill in them a sustainability mindset and allow them to play a greater role in Singapore?s green building movement,? he said.

IDA?s chief, Mr Ronnie Tay, said that as a growing number of companies look to host their IT operations in Singapore, ?there is a need to ensure the sustainable development of data centres.?

To encourage companies to green their data centres, the government introduced in June a tax incentive known as Investment Allowance Scheme for Energy Efficiency Projects (Data Centres), which allows firms to claim 30 to 50 per cent of their expenses on installing energy efficient equipment in data centres as tax relief.

U.S. top court justices challenge university race policy

WASHINGTON (Reuters) - Supreme Court justices on Wednesday vigorously challenged a University of Texas admissions program that favors some African-American and Hispanic applicants in a case that could determine how universities use affirmative action at campuses nationwide.

The legal battle is the most closely watched case of the court's current term, striking at the heart of two defining American characteristics - race and opportunity. The country's racial makeup has also changed significantly over time, with racial and ethnic minorities making up more than half of the children born in the United States for the first time this year, according to government data.

The University of Texas and its supporters contend that universities must have the flexibility to consider race to ensure diversity. Opponents say it is time to eliminate racial preferences, which they say are unconstitutional.

In Wednesday's arguments, members of the court's conservative wing pressed a lawyer for the university on the goals of affirmative action and whether universities would ever be able to stop using race in their admissions decisions.

Some of the liberal justices suggested the court should not overturn its prior rulings.

Justice Sonia Sotomayor summed up the central issue facing the court: "When do we stop deferring to the university's judgment that (considering) race is still necessary?" she asked. "That's the bottom line of this case."

The case involves Abigail Fisher, a white student who was denied admission by the University of Texas at Austin in 2008. Fisher sued the same year, claiming that racial minorities with worse credentials were accepted ahead of her. She argued that the school's use of race in admissions violated the U.S. Constitution's guarantee of equal protection. The university countered that it needed the flexibility to consider race as one of many factors to build a "critical mass" of underrepresented minorities.

'WHERE IS THE END POINT?'

Chief Justice John Roberts pressed university lawyer Gregory Garre on how judges would know when UT had achieved its desired level of diversity: "When will I know that you've reached a critical mass?"

Garre responded that critical mass is not a certain number but rather a point where "African Americans and Hispanics do not feel like spokespersons for their race." At that moment the university would stop using race in admissions, he said.

But Fisher's lawyer, Bert Rein, reiterated the Chief Justice's concern: "Where is the end point? If you have nothing to gauge the success of the program ... there is no judicial supervision."

Questions from liberal justices Ruth Bader Ginsburg, Sonia Sotomayor and Stephen Breyer implied support for the program. Breyer questioned Rein why the court should backtrack on past decisions that have allowed affirmative action.

Breyer asked Rein why the court should overturn a precedent into which "so much thought and effort went" and which "so many people across the country have depended on."

The overall tone of the hearing suggested that while the court might not uphold the Texas plan, there would not be a majority of justices to broadly strike down the use of race in admissions.

The justices who appeared most resistant to the Texas plan were Roberts and Justices Samuel Alito and Antonin Scalia. Justice Clarence Thomas, who asked no questions, would likely side with those conservatives based on his past writings on affirmative action.

Justice Anthony Kennedy, whose position may be decisive, signaled some concerns with the Texas plan but did not indicate by his questions that he was ready to curtail such nationwide practices.

NINE YEARS OF RELIANCE

The case arises nine years after the Supreme Court narrowly upheld affirmative action in a dispute over the University of Michigan Law School's admissions practices. By a 5-4 vote the court in 2003 said universities could consider an applicant's race alongside a host of other factors to improve diversity.

Public universities in 43 states that allow affirmative action and thousands of private colleges and universities have relied on that decision, Grutter v. Bollinger, to include race in their admissions decisions.

The Texas case has drawn more than 90 friend-of-the-court briefs from scores of academic institutions, think tanks and public interest groups, most in support of Texas.

The court's Public Information Office said people began lining up for spectator seats from 6 p.m. on Tuesday and waited overnight. More than 80 reporters had sought seats.

The court has changed since 2003. Justice Sandra Day O'Connor, who wrote the University of Michigan decision, retired in 2006 and has been replaced by the more conservative Alito. O'Connor watched the arguments in the courtroom on Wednesday.

SECURING RACIAL DIVERSITY ON CAMPUS

The University of Texas fills most of its entering class of freshmen using a policy that grants automatic admission to in-state students in the top 10 percent of their high school class. For the remaining slots it considers an applicant's race as one of many factors to improve diversity.

Fisher's claim rests on the legal argument that, under the Equal Protection Clause, universities can use race only if there is no other way to improve diversity. Fisher argues that the top 10 percent law is sufficient for boosting racial diversity.

The 5th U.S. Circuit Court of Appeals rejected her challenge, based on the Supreme Court's 2003 ruling.

Some of the justices suggested that because Texas considers an applicant's race for only part of its student body, the Texas program would easily pass the standard set forth in the 2003 case. Ginsburg described the University of Texas' use of race as "more modest" than the admissions policy in the Michigan case.

"If it's so few, then what's the problem?" asked Kennedy, referring to the number of slots the school fills using the race-conscious admissions policy.

But the fact that the gains from the race-based part of the process are so small, compared with the top 10 percent plan, could lead the court to conclude that the university does not need to rely on race at all.

Alito asked Garre how the university's use of race could "possibly do more than a tiny, tiny amount to increase classroom diversity."

The hundreds of demonstrators who gathered outside the courthouse on Wednesday overwhelmingly favored keeping the university policy intact. They carried signs saying: "Diversity works," "Out of many, one America" and "Expand Opportunity."

Cortney Sanders, a third-year student at the University of Texas and an African American, said: "The University of Texas used to be a school of exclusion, now it is promoting a policy of inclusion ... We are many people, but we are one America."

Only eight justices heard the oral arguments. Justice Elena Kagan, an Obama appointee who would be expected to endorse affirmative action, did not participate. Although she did not specify why she recused herself, she could well have worked on the case in her previous job as U.S. solicitor general.

A 4-4 tie would affirm the lower court decision in favor of Texas. If a majority rejects the Texas program, the overriding question is how broadly it will rule. It could reject only the Texas program or rule that universities can no longer consider race in choosing their students.

The court is expected to issue a decision before the term ends in June.

The case is Fisher v. Texas, U.S. Supreme Court, No. 11-345.
