Broker fees from mutual funds affect advice; predict worse performance, new study says

Jan. 30, 2013 ? Brokers are supposed to recommend investments that are in the best interests of their clients.

But a study published in the February 2013 issue of the Journal of Finance has found that mutual funds offering higher broker fees attract the most investments, especially when the broker is not affiliated with the mutual fund company. Every additional dollar paid to a broker corresponds with another six dollars invested into the fund, and another fourteen dollars if the broker is an unaffiliated third party whose compensation depends exclusively on sales commissions.

It also found these payments are linked to lower investment performance, especially when the fees come from one-time sales loads rather than ongoing payments.

It is the first such study to explicitly show how broker fees affect Investments Into funds and how they subsequently perform.

The freedom mutual fund companies have to decide how to compensate brokers has "real consequences" for the brokers' clients, the paper says. The implication, it adds, is there's a strong case for clearly showing customers how much their broker receives from their investment recommendations.

Brokers are typically compensated in two ways. If the fund is a front-end load, the investor pays a one-time charge, taken immediately off the top of their initial investment as a predetermined percentage. The broker receives the bulk of that charge.

"For the most part, investors are completely unaware," how much of the load goes to their broker, says Susan Christoffersen, a professor of finance at the University of Toronto's Rotman School of Management, who co-wrote the study with Richard Evans of the University of Virginia, and the University of Pennsylvania's David Musto. "If it's revealed, it would be in the statement of additional information or the details of a prospectus."

Investors may also not realize how much their brokers continue to receive out of their investments, via ongoing "trailer fees." These fees vary but in Canada make up about 40% of the management expense ratio, or MER.

The study looked at data on the performance and asset flows of U.S. mutual funds between 1993 and 2009 and related these with the fees paid to brokers disclosed in N-SAR filings to the U.S. Securities and Exchange Commission. The requirement for these filings arose directly out of regulators' concerns of conflicts of interest and the effect of broker fees on the growth and size of mutual funds.

Mozambique floods displace nearly 150,000

MAPUTO (Reuters) - Widespread flooding in southern Mozambique has displaced 143,000 people and aid agencies are struggling to get assistance to communities underwater for nearly a week, officials said on Wednesday.

The death toll from the flooding in the lower Limpopo river now stands at 80, Mozambican officials said, while aid groups said supplies of drugs and malaria test kits were running low, raising concerns about the spread of disease.

In the hardest-hit town of Chokwe, 140 km (90 miles) north of Maputo, only six out of 23 medical facilities were working and there were no ambulances, aid agency Medecins Sans Frontieres (MSF) said.

The homeless are being housed in 30 tent cities erected by the government with help from the United Nations.

"The Mozambican government and aid organizations are struggling to respond to the needs," the U.N. said.

The government in the impoverished former Portuguese colony refused to comment on the relief effort, putting a positive gloss on the situation in the badly hit district of Gaza.

"In Gaza, the water is receding considerably. In some places boats cannot even pass because there is not enough water," said Rita Almeida, a spokeswoman for the National Institute of Calamity Management.

At least 12 people have been killed in South Africa and 15,000 crocodiles escaped into the Limpopo, which also flows along southern Zimbabwe, when dams protecting a reptile farm on the banks of the river overflowed.

In Spring 2013, I will offer a new course at UCLA?s Anderson School of Management with the lofty title of ?Real Estate Investment and the Development of Sustainable Cities?. ? ? Here is the course blurb; ?This course applies key ideas from real estate economics and real estate finance to investigate the incentives of developers, urban politicians, and real estate investors?to produce ?green homes?, ?green communities? and ultimately ?sustainable cities?.?? Special attention will be paid to the opportunities from investing in energy efficient residential and commercial buildings and for developing and upgrading real estate in close proximity to public transit networks.? ?The course will embrace an international perspective to examine the rise of Eco-Friendly Cities in developed and developing nations.?

While I have already posted a preliminary syllabus here, ? I would appreciate hearing some advice about what topics and readings you would suggest including in such an experimental course. ?The students will not be Ph.Ds but they all will be graduate students from different branches of UCLA. ? The Anderson School has not offered this course before and if I screw this up ?it won?t be offered again!

NASA's Planet-Hunting Spacecraft Recovering from Glitch

NASA's Kepler space telescope has resumed its search for alien planets after resting for 10 days to work out kinks in its attitude control system, mission officials announced today (Jan. 29).

Kepler went into a protective "safe mode" on Jan. 17 after engineers detected elevated friction levels in one of its reaction wheels ? devices that maintain the observatory's position in space. Engineers spun the wheels down to zero speed, hoping the break would redistribute lubricant and bring the friction back down to normal.

That phase is now over and Kepler is back in action, though it will take time to determine if the problem is solved.

Kepler began coming out of safe mode at 2:30 p.m. EST (1930 GMT) Sunday (Jan. 27) and started collecting science data again at 8 p.m. EST Monday (Jan. 28; 0100 GMT Jan. 29), officials wrote in a mission update today. [Gallery: A World of Kepler Planets]

"The spacecraft responded well to commands and transitioned from thruster control to reaction wheel control as planned," Kepler mission manager Roger Hunter wrote in the update. "During the 10-day resting safe mode, daily health and status checks with the spacecraft using NASA's Deep Space Network were normal."

Kepler flags exoplanets by detecting the telltale brightness dips caused when they pass in front of their parent stars from the instrument's perpsective. The telescope requires three functioning reaction wheels to stay locked onto its roughly 150,000 target stars.

When Kepler launched in March 2009, it had four reaction wheels ? three for immediate use, and one spare. But one wheel (known as number two) failed in July 2012, so a major problem with the currently glitchy wheel (called number four) could spell the end of the $600 million Kepler mission.

It's unknown at the moment if the 10-day rest period will bring wheel number four back into line.

"Over the next month, the engineering team will review the performance of reaction wheel #4 before, during and after the safe mode to determine the efficacy of the rest operation," Hunter wrote.

The wheel has acted up before without causing serious problems.

"Reaction wheel #4 has been something of a free spirit since launch, with a variety of friction signatures, none of which look like reaction wheel #2, and all of which disappeared on their own after a time," Hunter wrote.

To date, Kepler has discovered more than 2,700 exoplanet candidates. While just 105 of them have been confirmed by follow-up observations so far, mission scientists estimate that more than 90 percent of them will end up being the real deal.

Disney closing 'Epic Mickey' video game developer

LOS ANGELES (AP) ? Now it's time to say goodbye to "Epic Mickey."

The interactive division of the Walt Disney Co. announced Tuesday that it is closing Junction Point Studios, its Austin, Texas-based developer that created 2010's "Disney Epic Mickey" and its 2012 sequel "Epic Mickey 2: The Power of Two."

Disney said the closure is part of its "effort to address the fast-evolving gaming platforms and marketplace" and to align its resources with its key priorities.

"We're extremely grateful to Warren Spector and the Junction Point team for their creative contributions to Disney with 'Disney Epic Mickey' and 'Disney Epic Mickey 2,'" the studio said in a statement.

Disney acquired Junction Point in 2007. The studio was led by "Deus Ex" and "Thief" creator Warren Spector.

Both "Epic Mickey" games were set in a twisted version of Disneyland called Wasteland and featured Mickey Mouse and Oswald the Lucky Rabbit as protagonists.

"I said to myself as Junction Point embarked on the 'Epic Mickey' journey that, worst case, we'd be 'a footnote in Disney history,'" Spector posted Monday on Facebook. "Looking back on it, I think we did far better than that. With Mickey Mouse as our hero, we introduced a mainstream audience to some cool 'core game' concepts ? and, most especially, we restored Oswald the Lucky Rabbit to a place of prominence."

The first "Epic Mickey," which was released only for the Nintendo Wii, was the sixth best-selling game the month it was released in 2010. "Epic Mickey 2," which was available for the Wii, as well as the Sony PlayStation 3 and Microsoft's Xbox 360, didn't crack the top 10 when it was released last November, according to gaming industry tracker NPD Group.

Disney unveiled plans earlier this month for a new franchise combining a toy line and a game called "Disney Infinity," similar to "Skylanders" from Activision-Blizzard Inc. "Infinity" is being developed by Disney's Salt Lake City, Utah-based developer Avalanche Software and is set to debut in June alongside "Monsters University," the 3-D prequel to the 2001 Disney-Pixar film "Monsters Inc."

After uncovering some details in Apple?s recently released iOS 6.1, rumors began circulating that Apple would be launching a new 128GB of the 4th-generation iPad with Retina display. Turns out the rumors were spot-on, as Apple has officially announced the latest high-capacity SKU for release on February 5.

Israel conducts airstrike on Syria

BEIRUT (AP) -- Regional security officials say Israel conducted an airstrike inside Syria overnight near the border with Lebanon.

The two officials did not say what the target was. But they said Wednesday that Israel had been making plans in the days leading up to the airstrike to hit a shipment of weapons bound for the anti-Israel militant group Hezbollah in Lebanon.

They said the shipment included sophisticated, Russian-made SA-17 anti-aircraft missiles, which would be strategically "game-changing" in the hands of Hezbollah.

Union chief vows ?full-fledged campaign? for immigration overhaul

AFL-CIO President Richard Trumka (Carolyn Kaster/AP)Organized labor is ?entirely behind? comprehensive immigration reform and will mount a ?full-fledged? campaign to help drive it through Congress, AFL-CIO President Richard Trumka told Yahoo News on Tuesday.

Trumka, whose federation comprises 57 unions representing some 12 million people, called the planned overhaul ?one of our top priorities right now.? He spoke by telephone from Las Vegas, Nev., where he was to attend President Barack Obama?s speech on immigration reform.

?We think everybody ought to have the right to work hard and to progress to citizenship,? Trumka said.

White House officials cite robust support from organized labor?which at times in recent history has opposed giving the estimated 11 million undocumented immigrants on U.S. soil a path to citizenship?as a key factor in their optimism about getting a comprehensive bill through Congress. They also point to the expansion of support among Christians, notably evangelicals. And they joke that the difficulty of managing a broad coalition is the kind of problem they like having.

Unions ?did have at one point some differences? on the issue, but ?the entire labor movement is entirely behind this now,? Trumka said. ?We?ll be at the table the whole time this thing is being developed to make sure it meets the needs of workers.? Once it?s drafted, he continued, ?we?ll be pushing this thing [with a] full-fledged campaign? aimed at both public opinion and wary lawmakers.

?We?ll be targeting those in the House or the Senate that either are recalcitrant and don?t want to do anything or aren?t where they need to be," he said.

Labor wants to see a comprehensive overhaul?"It can?t just be hit and miss," Trumka added?that does a better job of managing legal immigration to meet labor market needs, ensures employers are not exploiting undocumented immigrants, gives those on U.S. soil illegally a path to citizenship and makes sure that families are not broken up, he said.

Trumka also noted that unions are ?a little concerned? about a proposed provision in the bipartisan Senate framework requiring that undocumented immigrants seeking legal status provide ?a proven history of employment.? That could be difficult?employers may not want to admit that they hired such workers?but it could ?be defined in a very broad sense,? he said.

?The system is clearly broken right now, doesn?t work for anybody, doesn?t work for the country,? he added.

The AFL-CIO, the country's largest labor federation, isn't exactly a newcomer to the debate. It produced an outline of its own in August 2009. While organized labor's national clout has diminished along with shrinking membership, unions remain a core constituency for Democrats, and much of the party's backbone, providing cash and voter outreach.

Pricing and cloud support aside, the latest Office itself isn't a radical redesign. Everything feels familiar, with some small tweaks. It appears that Microsoft is attempting to reduce the bloat we occasionally experience when it comes to its software suite. Does it succeed? Well, we'll have to use the software for a bit longer to make a solid judgment call in regards to that.

While?the?latest version of the software isn't?lacking anything?from?the?traditional?desktop?view???in fact, our initial impression is that it might be the best version of Office we've used so far???we're still waiting for a finger-friendly tablet version of the?legendary?suite.?Though?it?would?be?a?huge?success?given?the?popularity?of?iPads?and?other?tablets,?Microsoft?isn't?going?to?rush?that?out?in?haste,?because?the?company's?developers?say?they?want?to?get?it?right.

House gives initial OK to college president bill

CHEYENNE, Wyo. (AP) ? A bill that would allow searches for University of Wyoming and state community college presidents to be closed to the public has cleared its first floor debate on the state House.

The House of Representatives advanced House Bill 223 on Tuesday. It faces to more votes in the chamber.

The bill was proposed after media outlets in the state protested the decision by the UW Board of Trustees to hold a secret search for a new president to replace retiring President Tom Buchanan.

Proponents of the bill argue the university could attract more quality candidates if the search is done confidentially and no names were released until the trustees choose a new president. Opponents contend the names of the finalists should be made public.

Grandson of oil tycoon T. Boone Pickens dies: University

FORT WORTH, Texas -- Police are investigating the death of Thomas "Ty" Boone Pickens IV, the grandson of oilman T. Boone Pickens and a student at Texas Christian University, the school said Tuesday.

The university released a written statement Tuesday.

?We are deeply saddened by the loss of this member of our community and our hearts and thoughts are with Ty?s family at this time,? said Kathryn Cavins-Tull, TCU vice chancellor for student affairs. ?Staff members are available if students need to speak with someone about this sad news.?

TCU360.com reports?Pickens was a junior strategic communication major.

The circumstances of Pickens' death were not immediately available. Fort Worth police Cpl. Tracey Knight said she had heard of the death but could not confirm if any investigation was under way or release any other details.

A spokeswoman for the Tarrant County Medical Examiner did not immediately return a call for comment.

A spokesperson for T. Boone Pickens said he was attending a family emergency in Fort Worth and offered no other details.

When former Illinois Gov. George Ryan steps out of prison on Wednesday after serving five-plus years for corruption, he will return to a life altered by personal tragedy and to a state altered by his and his successor's legacy of corruption.

Ryan, who is headed to a halfway house in Chicago, will encounter an Illinois that has enacted reforms meant to thwart the kind of wheeling and dealing the Republican was accused of engaging in. The state has also changed because of Ryan's legal actions as governor: Following his lead, Illinois abolished the death penalty in 2011.

His personal tragedies include the death of his wife and brother while Ryan was behind bars. Change for the 78-year-old has also included weight loss from walking the grounds at his Terre Haute, Ind., prison, said friend Rob Warden, who visited Ryan a few months ago and has corresponded with him over his years behind bars.

"When I saw him, he was upbeat," said Warden, who is also an anti-capital punishment activist. "He has reconciled himself to what happened to him." At the same time, said Warden, Ryan still maintains that the actions for which he was convicted in 2006 never crossed the line into criminality.

Jurors convicted Ryan on multiple charges, including racketeering and conspiracy. They agreed that, among other crimes, he had steered state business to insiders as secretary of state and then as governor in exchange for vacations and gifts. He began serving a 6 ?-year prison sentence in November 2007 and is being released early into a halfway house under a work-release program.

Thanks to his long-running legal saga, Ryan comes out of prison with no money, his attorneys have said. His state pension was yanked.

The most jarring change for Ryan is that his wife of 55 years, Lura Lynn, died in 2011. He was allowed to visit her in hospital but not to go to her funeral.

His own health has suffered. He's dealt with kidney disease and infected teeth.

It's unclear how Ryan might support himself. He became a celebrity among activists devoted to abolishing the death penalty and they say he could play a role as their national spokesman, possibly going on speaking tours across the country.

Ryan switched from the pro- to anti-death penalty camp in the early 2000s, clearing death row while he was governor. Some critics questioned Ryan's motivation, saying it was a political diversion. But Warden, the executive director of the Chicago-based Center on Wrongful Convictions, and others disagree.

"He's stepping into a changed world ? and it's a changed world partly because of the leadership he showed (opposing capital punishment)," said Diann Rust-Tierney, president of the Washington, D.C.-based National Coalition to Abolish the Death Penalty.

Before he even endeavors to take on post-prison challenges or opportunities, Ryan will take in the pleasure of no longer being behind bars, said former Chicago city clerk Jim Laski, who was sentenced to two years in prison for corruption in 2006.

SPORTS: Big Green tennis teams open on a mixed note

Despite the snow on the ground, the Dartmouth men?s and women?s tennis teams have both kicked off their spring seasons with January matches. The men?s (0-2) and women?s (1-1) teams have both competed in two contests so far.

The Big Green men began with the Dartmouth Kickoff Classic, hosting matches against Clemson University this past Friday and Purdue University on Saturday at the Boss Tennis Center. Dartmouth and its opponents agreed ahead of time to call off any matches still in progress once one side secured a victory.

?We opened this year with two very good teams and both were from very strong conferences, so these were two good tests to see where we are,? Alexander Centenari ?13 said. ?Both matches were close, particularly Purdue, and we gained a lot of good experience, especially for some of the younger guys.?

In its first match of the spring season, the Dartmouth men lost 4-0 to Clemson. On the doubles side, Cameron Ghorbani ?14 and Brendan Tannenbaum ?16 dropped their match 2-8 to the Tigers (5-0) at the number one spot. Alexander De Chatellus ?13 and Erik Nordahl ?16 fell 6-8 to their opponents at the number two spot, clinching the doubles point for Clemson. At the number three spot, team captain Centenari and Brandon Debot ?14 were leading their opponents 7-6 when the match was called.

In singles competition, Centenari dropped his match 2-6, 3-6 at the number one spot, while teammates Christopher Kipouras ?15 and Nordahl also fell to their opponents in straight sets at the three and four spots respectively. When the matches were abandoned, Ghorbani and Justin Chan ?16 were both defeating their Clemson challengers.

?This weekend was a really good learning experience in terms of seeing how to deal with all the different things that can come up during a dual match, and also showed us the level we?ll have to compete at to beat good teams like them this season,? DeBot said. ?I think we showed that we can compete at this level but definitely have some work to do to come out on top in matches like these later on.?

In their second match of the season, the Big Green men lost a heartbreaking match 3-4 to Purdue (7-0, 0-0 Big Ten). In doubles competition, Centenari and DeBot won their match 8-2 at the number three spot. Tannenbaum and Ghorbani and De Chatellus and Nordahl dropped their matches at the first and second spots to put the Boilermakers ahead 1-0.

In singles play, Centenari won in the second spot in straight sets 6-2, 6-3. Kipouras and Chan also won in straight sets in the number three and six spots, respectively. While securing three points in singles, the Big Green could not pull out a win against the Boilermakers.

Centenari said that the team will learn from these losses and move forward.

?Losses are always tough, but are often the best ways to figure out some glaring weaknesses,? Centenari said. ?Everyone has things they can improve on, and we are ready to train hard and smart this week to get ready for next weekend.? The Dartmouth women?s tennis team also had a setback to start the season, dropping its opening match of the spring season 2-5 against Boston College on Jan. 19 in Hanover. The Eagles (2-0) swept the doubles matches, putting Boston up 1-0. The Big Green, however, won two matches in singles competition. Janet Liu ?15 bested her opponent in the number one spot when she was forced to retire because of an injury. Akiko Okuda ?15, competing at the number three spot, scored Dartmouth?s other point of the day, defeating her opponent in a third set super-breaker 7-5, 4-6, 1-0 (10-8).

The Big Green women bounced back from their loss against the Eagles with a decisive 7-0 win against Binghamton University at home on Saturday. Melissa Matsuoka ?14 and Sarah Bessen ?16, as well as Suzy Tan ?16 and Julienne Keong Si Ying ?16 both cruised to 8-1 victories in the number two and three spots, respectively. In the number one spot, Okuda and Katherine Yau ?16 bested their opponents 8-4.

?Our matches against Binghamton and BC were really valuable,? women?s captain Sarah Leonard ?13 said. ?BC is a very good team, and it was good for us to start our season with solid competition.?

In singles action, Ying made quick work of her opponent, winning 6-0, 6-0 at number six. Yau, Liu, Okuda, Matsuoka and Tan all coasted to victories winning in straight sets.

?We will continue to work on improving our doubles play, court positioning and movement,? Leonard said. ?I?m excited for us to continue improving and to showcase our talents against really good competition as we move forward.?

Both teams will be back in action on Friday. The men will host Old Dominion University at 2 p.m. while the women will take on the University of Wisconsin at 6 p.m. in Boss.

Newtown expands scope of planned children's museum

NEWTOWN, Conn. (AP) ? Months before she was killed in a gunman's rampage, Sandy Hook Elementary School Principal Dawn Hochsprung wrote a letter expressing her excitement over an effort to bring a children's museum to Newtown.

At the time, the proposal was fairly modest: a building of perhaps 20,000 square feet would provide art and science programs for area children.

Since last month's massacre, the plan has become more ambitious, with museums around the country collecting donations and organizers looking to renovate a 52,000-square-foot building to host the new learning center. A capital campaign that was to begin in the spring will start right away, with hopes of raising $10 million instead of the original $4 million.

"The need for the children's museum, which everyone thought was a great idea before, became almost a necessity," said Kristin Chiriatti, the museum's president. "People understood that the children will need a place to heal. We have so many children who are scared to go to school now and may have lifelong poor associations with learning."

It will still be a community museum, Chiriatti said, but it will also be a destination point for southwestern Connecticut.

The museum, first proposed in 2011, was to feature rotating exhibits on such topics as electricity, sound and outer space. Chiriatti called it "Everwonder," a play on the wonder the museum is meant to evoke and her question as to whether it would be possible to build, she said.

The group had been involved in hosting programs at the local library and envisioned a place for children to draw and conduct experiments.

Hochsprung wrote to Chiriatti in March that she supported the idea to engage students with hands-on, interactive experiences.

"In order for students to learn, they must be invested in what we are teaching," she wrote.

On Dec. 14, Hochsprung was among the victims of the rampage that killed 20 first-graders and six educators at Sandy Hook. The 20-year-old gunman killed his mother before driving to the school, opening fire and then committing suicide as police arrived.

The museum building will include some type of memorial to Hochsprung and the other victims, Chiriatti said.

"These children were our children's friends," she said. "We haven't decided how it will be done, except that it will be done in a cheerful way that celebrates childhood and education. Because that's what this is about: creating a cheerful place, filled with learning and enjoyment."

Architects and other professionals have agreed to volunteer for the project, which is tentatively planned for the campus of Fairfield Hills Hospital in Newtown.

And Chiriatti is getting help from other museums across the country.

Robert Dean, the executive director of a children's museum in Grand Rapids, Mich., got involved the day of the shooting, after a 9-year-old son of his museum's board president asked how they might help the kids in Newtown. He called a board meeting to brainstorm.

"We talked a letter-writing campaign and other things, but when we learned they were trying to build a children's museum, I just thought, 'Wouldn't it be great if they could have the same thing we have?'" he said.

A dollar from each admission fee collected at that museum and two others in Grand Rapids last Saturday will be donated to the Everwonder project.

Dean contacted the Association of Children's Museums, which launched a national effort. Museums are being asked to set aside one day this year and donate $1 from each admission that day to Everwonder. Chiriatti said she has already heard from four ? the Children's Museum of Brownsville, in Texas; the Seattle Children's Museum; the Tucson Children's Museum, in Arizona; and the Bucks County Children's Museum, in Pennsylvania.

She said they are hoping to raise all they need without seeking any money from an $8.5 million fund set up by the United Way to support the community after the massacre.

"They need to identify where that money is really needed, what is most important," she said. "If they need a counseling center, that should be where that money goes. It would be great to get some help, but we're certainly not going to be actively seeking that funding if it's needed somewhere else."

Chiriatti said they hope to have their museum opened by the end of 2015.

Government gets initial 340 million pounds from Swiss tax deal

LONDON (Reuters) - Britain has received an initial 340 million pounds from the Swiss government as part of a deal to tackle tax evasion that the government expects will net it some 5 billion pounds over the next six years.

Switzerland agreed with Britain last year to impose a one-off levy on money in Britons' secret Swiss bank accounts and to tax future interest payments, with effect from the start of 2013. Germany rejected a similar deal.

Switzerland has been under pressure from the United States, Germany and Britain to clean up its private banking system, which has allowed many wealthy foreign nationals to avoid tax due to its tradition of bank secrecy.

"Last night HMRC (UK tax authorities) received 340 million pounds from the Swiss government, in the first instalment of a deal we have struck," Chancellor George Osborne told parliament. "(This is) the first time in our history that money due in taxes has flowed to this country from Switzerland, rather than the other way round," he added.

Osborne was facing criticism in parliament about his fiscal plans, which are already two years behind on their original goal of eliminating the country's structural budget deficit by 2015. Borrowing in the 2012/13 tax year is forecast to total 108.5 billion pounds, equivalent to 6.9 percent of economic output.

The 340 million pounds is a shade over the 330 million pounds pencilled in to come from this source during the 2012/13 tax year. Some 3.12 billion pounds is expected in the next tax year, and total tax receipts out to 2017/18 are seen at just over 5 billion pounds.

Britain has made tackling tax avoidance by companies as well as individuals a priority for its presidency this year of the G8 group of major advanced economies.

Anglo American takes $4 billion hit on Minas Rio

LONDON (Reuters) - Anglo American Plc will take a $4 billion writedown on its Minas Rio iron ore operation in Brazil after delays and cost overruns forced the mining group to increase expenditure on the project.

The company also said on Tuesday that it expects capital expenditure for the project to increase to $8.8 billion.

"We are clearly disappointed that the diversity of challenges that our Minas Rio project has faced has contributed to a significant increase in capital expenditure," outgoing Chief Executive Cynthia Carroll said.

"Despite the difficulties, we continue to be confident of the medium and long-term attractiveness and strategic positioning of Minas Rio and we remain committed to the project."

Minas Rio, a leading iron ore project in Brazil, is Anglo's most significant failure of recent years and was largely responsible for Carroll's fall from grace.

Anglo bought its first stake in Minas Rio in 2007, taking control in 2008 with a $5.5 billion deal with Brazilian billionaire Eike Batista's MMX - right at its peak.

The project was intended to help to diversify a company that was still dependent on South Africa for the bulk of its revenue, but has instead been a bruising top-of-the-market deal.

'CONSTANT DISAPPOINTMENT'

Anglo spent $4.8 billion buying Minas Rio - excluding the value of the Amapa mine, bought as part of the original deal but which Anglo has agreed to sell. It has spent $5 billion on developing it so far and said last year that total development costs could exceed $8 billion - more than three times original estimates.

"This asset has been a constant disappointment in terms of project delivery and I think it was largely expected that we would get this sort of writedown," Nomura International analyst Sam Catalano said.

"The challenge that remains for Anglo is to deliver it on the revised timeline and price that they've given us."

The company said it is still targeting first ore on ship by the end of 2014 despite the challenges facing Minas Rio.

Anglo's announcement comes after Rio Tinto ousted its chief executive, Tom Albanese, on January 17 and took $14 billion in impairments tied to its underperforming Mozambican coal and Canadian aluminum operations.

Other mining companies, such as BHP Billiton are also likely to write down underperforming assets as low prices and rising costs eat into valuations.

Minas Rio is one of the biggest challenges facing Anglo's incoming chief executive Mark Cutifani, a former coal miner who will join the company from Johannesburg-based AngloGold Ashanti in March.

Development costs in Brazil have been driven higher by forthcoming major events such as the Olympics in 2016 and next year's soccer World Cup tournament, which have increased demand for labor.

Shares in Anglo American were down 0.6 percent at 1862 pence at 0802 GMT, valuing the company at $41.2 billion.

Elsewhere in the sector, Anglo American Platinum , the world's largest platinum producer, said on Tuesday that it had conducted "constructive" consultations with the South African government about a company restructuring that could lead to 14,000 job cuts.

The Engadget Interview: Daniel Graf talks Google Maps for iOS (video)

The Engadget Interview Daniel Graf talks Google Maps for iOS

"It has been a wonderful success for us," says Daniel Graf about Google Maps for iOS. Originally from Switzerland, Graf worked for Leica and Phillips, and went on to co-found video service Kyte before landing at Google in 2011. There, he ran the mobile apps lab before taking the role of director of Google Maps for mobile, where he oversees the Android and iOS versions of the iconic mapping app. We recently got the chance to spend a few minutes with Graf at Google's Mountain View headquarters to discuss the iOS app, which launched last December. He's clearly passionate and proud of his work: "It has been an interesting project, because we got the opportunity to start from scratch." Graf explains that the Android version "is actually seven years of history, seven years of product, [...] seven years of user experience. On iOS, we didn't have those seven years so that gave us a chance to take a step back and say. 'Hey, what would be the next-generation mobile mapping experience?'" Read on after the break.

With iOS 6, Apple ended its partnership with Google and experienced some growing pains with its own mapping app. Still, even in iOS 5, the app only offered a fraction of the functionality provided by Google Maps for Android -- lacking voice guidance and 3D views, for example. Graf and his team set out to create an iOS app that wouldn't just catch up with the Android version, but would also showcase the direction the company was taking in terms of user experience. "When Larry [Page] came on board as CEO two years ago, he talked about beautiful experiences and we had very functional and very useful experiences and in term of beauty I think there was work to do," says Graf. "Now two years later if you actually use our product on desktop, on Android, on iOS there's a theme there ... there's a design language there, and I would say actually they're beautiful."

It's not just Google Maps for iOS that's been revamped. Over the past nine months, the company's been busy updating its mobile apps across the board with a more cohesive look and feel. It all started with Google Now -- launched alongside Jelly Bean at Google I/O -- followed by Google+ on both platforms, and more recently GMail and Google Maps on iOS. Interestingly, the Android version has not (yet) been updated to reflect the new design language. The iOS app makes extensive use of info sheets similar to those used in Google Now. "Given the feedback we have gotten from our audience about the user experience here, I would say this is kind of the direction we want to move forward," says Graf. "It's way more use-case driven ... It should actually happen based on your actions."

We asked Graf what challenges his team encountered while building Google Maps for iOS. "With a mapping app, it's actually similar to a gaming app because the map you see here, the 3D rendering we have here, so you need a 3D renderer; you need an engine for that, and that was new for us -- a 3D renderer for iOS." The iOS app is written in Objective C (versus Java on Android) and required fine tuning: "To get that to a performance [level] where we have it now, that was definitely a technical challenge." But there was another hurdle on iOS: "There's no common login infrastructure like we have on Android -- hopefully that's coming." When pressed whether this is a political issue (related to Apple's stringent app requirements) Graf mentions that "it's a business decision, but it's a technical challenge as well."

Despite being more polished than its Android counterpart, Google Maps for iOS lacks some features, such as Latitude (it's a separate app). Graf admits that "it would be quite interesting to see your friends on the map within Google Maps for mobile." For this version, however, it was important to simplify: "We obviously wanted this app out before the holidays, which we managed to do in December, so there was a lot of time pressure to get it out but we didn't want to make compromises so we said is let's focus on the key use cases which I think we nailed." We inquired about how much Google Maps development is cross-platform. "Of course we have an Android team; we have an iOS team; we have different platform teams and they work very closely together," says Graf. "You do want basically the best experience possible for a platform, so you probably have to develop native." Watch the full video interview above.

Bodies of missing Mexican band members found in well

MONTERREY (Reuters) - Police found a dozen bodies inside a well in northern Mexico, some of them members of a band abducted last week by an armed group, a spokesman for the state of Nuevo Leon, Jorge Domene, said on Monday.

Authorities have identified four of the bodies, including that of a Colombian national. All were wearing jeans and T-shirts with the logo of the music group - "Poderoso Kombo Kolombia."

One band member who managed to escape told police that after he and the others were kidnapped, their armed men captors asked them if they belonged to an organized crime gang. They were shot when they refused to answer.

It was not clear how the surviving band member escaped or whether he was wounded. Domene said he had fled Mexico after reporting the attack.

A total of 18 men, 12 musicians plus staff, were abducted on Thursday at a party in a bar near the industrial city of Monterrey, Domene said.

"Presumably there could be more bodies so we will extend the search as far as conditions allow it," he told a press conference.

Mexican President Enrique Pena Nieto has vowed to reduce criminal violence that spiraled after his predecessor, Felipe Calderon, launched an assault on drug cartels in December 2006. Some 70,000 people have been killed in drug-related violence in Mexico since then.

Former Ecuador judge on Chevron case says plaintiffs bribed court

NEW YORK/SAN FRANCISCO (Reuters) - A former Ecuadorean judge has claimed that after stepping down from the bench, he illegally ghostwrote a judgment in which Chevron was ordered to pay $18.2 billion (11.5 billion pounds) for polluting the rain forest, and that the plaintiffs paid a $500,000 bribe to the judge who issued the ruling.

Alberto Guerra, who presided over the case from 2003 to 2004, made the allegations in a sworn statement filed by Chevron on Monday in support of a lawsuit in Manhattan federal district court accusing the Ecuadorean plaintiffs and their lawyers of fraud.

"Another participant in the fraud has now come forward rather than wait to be exposed by others," Hewitt Pate, Chevron vice president and general counsel, said in a statement.

Karen Hinton, a spokeswoman for the plaintiffs, in a statement called Guerra a "disgraced former Ecuadorean judge who is being paid hundreds of thousands of dollars by Chevron to make false allegations about the Ecuador trial court judgment."

Guerra was not available to comment.

The filing is the latest in an ever-escalating two-decade battle between Chevron and residents of Ecuador's Lago Agrio over oil extraction in the region.

Residents claimed that Texaco, which Chevron acquired in 2001, polluted the rainforest and water supplies with hundreds of unlined waste pits from 1964 to 1992, damaging crops and public health including deaths from cancer.

Chevron claimed that its share of the waste pits had been cleaned up and that its activities were not responsible for environmental and public health damage.

An Ecuadorean court entered the $18.2 billion judgment in 2011. The award was upped to $19 billion in July.

The National Court of Justice, Ecuador's highest court, last month appointed three judges to hear Chevron's final appeal in that country of the court decision.

One of them, Oscar Bermudez, told Reuters that they are not allowed to consider new evidence.

"Our job is to make sure the sentence issued by the previous court complies with legal and constitutional precepts ... they can provide new evidence but the court cannot take it into account," he said, adding that Chevron may consider presenting Guerra's statement to Ecuador's attorney general for his consideration.

Chevron, with no assets in Ecuador now, has fought a global campaign against the enforcement of the $19 billion award. In February 2011, it filed the New York federal lawsuit against the plaintiffs and their lawyers, including Steven Donziger and Pablo Fajardo, contending the judgment was obtained via fraud.

The declaration Monday by Guerra was filed by Chevron in support of that lawsuit.

According to the document, the Chevron case had been assigned to Judge Nicolas Zambrano in 2009. Guerra said Zambrano at times ask him to ghostwrite civil rulings for him for $1,000 a month, which he says was illegal.

The case was then given to another judge, Juan Nunez, who later had to recuse himself due to allegations of bribery brought by Chevron after Nunez was caught on tape discussing the case. Zambrano then took charge again.

In his sworn declaration, Guerra wrote: "Zambrano told me he was in direct contact with Mr. Fajardo and that the Plaintiffs' representatives had agreed to pay him USD $500,000 from whatever money they were to collect from the judgment, in exchange for allowing them to write the judgment in the Plaintiffs' favor."

Guerra in his declaration said he received $38,000 from the company for the costs of providing the evidence. Kent Robertson, a spokesman for Chevron, confirmed Chevron has agreed to pay Guerra's family $10,000 for monthly living expenses and $2,000 for housing.

"He's a scoundrel," Fajardo told Reuters on Monday. "I've never met Mr. Guerra, but I know who he is and how he's being paid by Chevron."

In a statement from the Ecuador plaintiffs last week, Fajardo said Guerra had at one point offered to provide testimony to the rainforest communities if they would pay him, though they had refused.

Zambrano could also not be contacted on Monday. He has been out of the public eye since his dismissal last February for releasing a drug trafficker in an act described by the judicial watchdog as "obvious negligence."

The New York case is Chevron Corporation v. Donziger, et al., U.S. District Court, Southern District of New York, 11-00691.

(AP) ? Rudy Gay to Toronto. Rudy Gay to Boston. It's easier to count the teams who don't covet Gay.

But as long as he's still with Memphis, Gay is doing what he can to help the Grizzlies win.

Gay scored 26 points and scored the winning basket off his own rebound with 13.3 seconds left to lead Memphis to a 103-100 win over the Philadelphia 76ers on Monday night.

Gay's name is one of the hottest around in NBA trade rumors. The Grizzlies, who rallied from 17 points down to beat the Sixers, are fourth in the Western Conference and listening to offers for their leading scorer.

He showed his value down the stretch, hitting the go-ahead bucket, then sinking two free throws to seal the win.

"Whether I'm here or not, it shouldn't affect this team," Gay said. "I'm going to be a professional about it and make sure that it doesn't."

He added: "Wherever I go, I'm going to be me."

Marc Gasol scored a season-high 27 points and Jerryd Bayless had a season-high 21 to help the Grizzlies win without point guard Mike Conley. Conley sat out with a sprained left ankle suffered in Sunday's loss to New Orleans.

The Grizzlies rallied from their double-digit deficit to take control late in the fourth. Bayless missed a jumper, Gay grabbed the rebound and put Memphis up 101-100 on a bucket with 13.3 seconds left.

"When the ball's up, you've got to go it," Gay said. "I just went to go get it."

Philadelphia's Thaddeus Young missed a short attempt in front of the basket and the Grizzlies grabbed the rebound. Gay hit both attempts from the free-throw line for the three-point cushion.

Nick Young couldn't get the tying shot off at the buzzer for the Sixers.

Tied at 79-all to start the fourth, neither team could break free the rest of the quarter.

Gasol hit a tiebreaking 3-pointer for a 93-90 lead but Evan Turner came right back with a short jumper and Thaddeus Young gave the Sixers a one-point lead after Memphis was whistled for an offensive foul.

Spencer Hawes hit a jumper and Jrue Holiday followed with basket after a fortuitous bounce popped the ball straight up off the rim and through the net for a 98-95 lead. It wasn't enough. The Sixers still haven't won consecutive games since they had a three-game winning streak from Nov. 25-30.

Turner scored a season-high 27 points, Thaddeus Young had 23, and Holiday had 18 points and 10 assists.

"We're playing great," Turner said. "You think bad luck just keeps rolling? Basketball's a game of runs."

Turner said the Sixers will be better once, "the big fella comes back."

He's about ready. Andrew Bynum, their 7-foot center, has targeted a post-All-Star break return from bone bruises in his knees that have sidelined him the entire season. The former Lakers All-Star, acquired in the offseason, dunked on Sunday for the first time with Philadelphia, a "baby step," in a comeback the Sixers are counting on to lift them into the playoff race.

Bynum sprinted at shootaround for the first time, and could practice by the end of the week.

Coach Doug Collins said Bynum can't wait to play.

"I think the most important thing is he's encouraged, that he's feeling better," he said before the game. "You can always tell when guys start feeling better. When you're hurt, you don't feel like you're part of the team."

He would have helped against Memphis.

"He'll close down the middle," Turner said.

Aided by near-flawless shooting, the Sixers had their highest-scoring first quarter of the season. They made 12 of their first 14 shots, including two 3s by Nick Young, and raced to a 17-point lead. A 44-percent shooting team, the Sixers made their first seven shots and led 33-20 at the end of the quarter.

Perhaps inspired by the sharp shooting, the Grizzlies came right back with a 14 of 18 second quarter, to take a 57-54 lead at halftime. Bayless was 7 of 10 for a season-high 19 points in the half. Not his high for a half. A game.

They kept the comeback rolling in the second half and won for the fifth time in the last seven games.

"It looked like the last team that made the run, got the win," coach Lionel Hollins said. "We were the last team that made the run."

NOTES: 76ers G Jason Richardson (knee) missed his fourth straight game. ... Collins said he felt fine after leaving Saturday's game and missing practice the next day because of a sinus infection and blocked nasal passage. ... 76ers C Lavoy Allen needed stitches in his upper lip. ... Grizzlies F Zach Randolph had 12 rebounds.
