Group seeks appellate action on gays in military (AP)

SAN DIEGO ? The military's ban on openly gay troops will be lifted within weeks, but the policy can still be re-enacted in the future.

That's why a Republican gay rights organization that sued the Obama administration to stop enforcement of the policy says it will ask the 9th U.S. Circuit Court of Appeals during a hearing Thursday to declare the nearly 18-year-old law unconstitutional, affirming a lower court's ruling last year.

With several Republican presidential candidates, including Rep. Michele Bachmann, indicating they would favor reinstating the ban if elected, such a ruling is needed, said Dan Woods, the attorney for the Log Cabin Republicans. Declaring the law unconstitutional would also provide a legal path for thousands discharged under the policy to seek reinstatement, back pay or other compensation for having their careers cut short, Woods said.

"The repeal of `don't ask, don't tell' doesn't say anything about the future," Woods said before the hearing in Pasadena, Calif. "It doesn't (explicitly) say homosexuals can serve. A new Congress or new president could come back and reinstitute it. We need our case to survive so there is a constraint on the government to prevent it from doing this again."

During her campaign stop in Iowa in August, Bachmann told interviewer Candy Crowley on CNN's "State of The Union" when asked whether she would reinstitute the law: "It worked very well and I would be in consultation with our commanders, but I think, yes, I probably would."

Justice Department attorneys have filed a motion asking the appeals court to dismiss the case, arguing that the repeal process that will lift the ban Sept. 20 makes the lawsuit irrelevant.

Not so, says Richard Socarides, a former adviser on gay rights to Democratic former President Bill Clinton's administration, which enacted "don't ask, don't tell."

"Anyone focused on ending this policy for good should want this ruling to stand on appeal," Socarides said Thursday. "It's an important statement about who we are as a country and our values ? values that say discrimination is unconstitutional. It's not enough to say we repealed it. We need to declare it wrong, unconstitutional and illegal."

The Log Cabin Republicans successfully won an injunction by U.S. District Judge Virginia Phillips last year that halted enforcement of "don't ask, don't tell" briefly, before the 9th Circuit reinstated it.

Justice Department attorneys say Phillips declared the law unconstitutional before the repeal process began, and that repeal of a statute invalidates such constitutional challenges.

But if the policy's fallout is still having an impact on people's lives then the court could still rule on the law's constitutionality, said Erwin Chemerinsky, University of California, Irvine's law school dean.

Nearly 14,000 military members have been discharged under the statute.

Woods said the government is trying to "remove the legal precedent established in our case so that anyone claiming back pay, reinstatement or a change in discharge status" could not take advantage of that and remedy the harm done by the unconstitutional law.

Woods submitted to the court the discharge paperwork of three service members who testified at last year's trial. Their paperwork bears a re-entry code stating "Not Applicable" or designating the person ineligible for re-enlistment.

Two of the service members, including former Air Force Maj. Michael Almy, are part of a separate lawsuit filed against the government demanding their reinstatement. Almy, 41, said he was discharged in 2006 after a fellow officer snooped through his government computer in Iraq.

"It is mind-boggling that throughout this case, the Obama administration has said repeatedly that it favors open military service, yet it has fought us every step of the way and is now appealing the court's judgment in our client's favor," Woods said. "The federal government should be working with us, not against us."

DOJ attorneys declined to be interviewed.

In their motion, they point out that discharged gay personnel can reapply and asked that the court throw out both lawsuits, warning any ruling could disrupt the orderly repeal process that military leaders and Congress established to ensure the change does not disrupt the armed forces during wartime.

The Defense Department says it will waive no re-entry codes for those with honorable discharges made under the policy, and they will be treated like other prior service members who are accepted based on need. All military branches are at full capacity and plan to reduce their forces.

"In keeping with long-standing traditions of deference to the judgments of military leaders concerning military matters, specific re-accession decisions ? which individuals should be selected to serve in what capacities in our nation's military ? should be made by military leaders, rather than this court," government attorneys said in their motion.

Scientists from the University of York have played a pivotal role in a discovery which could finally unlock the full potential of waste plant matter to replace oil as a fuel source.

Professor Paul Walton and Professor Gideon Davies, of the University's Department of Chemistry, were part of an international team that has found a method to overcome the chemical intractability of cellulose, thus allowing it to be converted efficiently into bioethanol.

Working with scientists in Novozymes laboratories at Davis, California, and Bagsvaerd, Denmark, as well as researchers at the University of Copenhagen and the University of Cambridge, they identified the molecular mechanism behind an enzyme found in fungi which can degrade the cellulose chains of plant cell walls to release shorter sugars for biofuels.

This represents a major breakthrough as cellulose is the world's most abundant biopolymer. Global generation of cellulose is equivalent in energy to 670 billion barrels of oil some 20 times the current annual global oil consumption. The discovery opens the way for the industrial production of fuels and chemicals from plentiful and renewable cellulose in waste plant matter.

The research, which is published in the Proceedings of the National Academy of Sciences (PNAS), removes the major constraint on the production of bioethanol from cellulose the stability of which had previously thwarted previous efforts to make effective use of it for biofuels.

The researchers found a way of initiating effective oxidative degeneration of cellulose using the copper-dependent TaGH61 enzyme to overcome the chemical inertness of the material.

Professor Davies, much of whose work on plant cell-wall degradation is funded by the Biotechnology and Biological Sciences Research Council, said: "Cracking cellulose represents one of the principal industrial and biotechnological challenges of the 21st century. Industrial production of fuels and chemicals from this plentiful and renewable resource holds the potential to displace petroleum-based sources, thus reducing the associated economic and environmental costs of oil and gas production. Events at Fukushima and the continuing instability in major oil producing countries only highlight the need for a balanced energy portfolio."

Professor Walton added: "This discovery opens up a major avenue in the continuing search for environmentally friendly and secure energy. The potential of bioethanol to make a major contribution to sustainable energy really now is a reality."

Claus Crone Fuglsang, Managing Director at Novozymes' research labs in Davis, California said: "Scientists have worked to figure out how to break down plant matter for the past 50-60 years. The impressive effect of GH61 was established a few years back and today it is a key feature of our Cellic CTec products.

"Fully understanding the mechanism behind GH61 is important in the context of commercial production of biofuel from plant waste and a true scientific paradigm shift. This discovery will continue to drive advances in production of other biobased chemicals and materials in the future."

Leila Lo Leggio, Group Leader of the Biophysical Chemistry Group at the Department of Chemistry, University of Copenhagen, said: "As a team of academic scientists, it is particularly rewarding when our basic research in the three-dimensional structure and chemistry of proteins also contributes to possible solutions for one of the major challenges our society is facing."

Professor Paul Dupree of the University of Cambridge Bioenergy Initiative and Director of the BBSRC Sustainable Bioenergy Cell Wall Sugars programme, said "Understanding the GH61 enzyme activity is one of the most significant recent advances in the area of biomass deconstruction and release of cell wall sugars."

Advancements in speech therapy have allowed for enhanced and improved therapy for people with speech, language, learning, and cognitive impairments. Modern and cutting edge medical procedures and devices have resulted in an increase in the number of lives being saved after traumatic accidents and health conditions such as strokes. This has led to a greater demand for speech language pathologists. Speech-language pathologists can be found working in child development centers, preschools, schools, hospitals, rehabilitation centers, government agencies, research centers, and anywhere one needs communication therapy. They are part of medical community and are highly valued for the treatment techniques they provide. With new advancements emerging everyday, the future looks bright for the field of speech language pathology.

All of these advancements have lead to significant growth in speech pathology jobs throughout the world. Also on the rise are nurse practitioner jobs and other medical positions.
